These Terms & Conditions apply to all photography services provided by Ana Boicenco Photography (“the Photographer”, “I”, “me” or “my”).
By booking a photography session, paying the €50 booking deposit, or otherwise engaging Ana Boicenco Photography for photographic services, you confirm that you have read and agreed to these Terms & Conditions, subject to your statutory rights under applicable Irish law.
1. Booking & Deposit
A €50 booking deposit is required to secure your photography session and reserve your chosen date and time.
Your booking is confirmed once the €50 deposit has been received.
The deposit is non-refundable if the Client cancels the booking or fails to attend the scheduled session, subject to any statutory rights the Client may have under Irish consumer law.
The deposit may be transferred to a rescheduled session where the applicable rescheduling policy is followed.
If Ana Boicenco Photography needs to cancel the session and is unable to offer a suitable alternative date, the €50 deposit will be fully refunded to the Client.
The deposit will otherwise be retained in accordance with these Terms & Conditions.
2. Cancellation Policy
If you need to cancel your photography session, you must provide at least 24 hours' notice.
If the Client cancels with less than 48 hours' notice, the €50 deposit remains non-refundable.
If the Client cancels more than 48 hours before the scheduled session, or fails to attend the session without reasonable notice, the €50 deposit will be retained.
Where applicable, any statutory cancellation or refund rights under Irish consumer law will continue to apply.
If the Photographer cancels the session and cannot provide a suitable alternative date, the €50 deposit will be fully refunded.
3. Rescheduling Policy
If you need to change your appointment, you must request to reschedule at least 48 hours before your scheduled session.
Rescheduling requests made with at least 48 hours' notice will be considered subject to the Photographer’s availability.
The original €50 deposit can be transferred to the new appointment where the rescheduling policy has been followed.
If the Client requests to reschedule with less than 48 hours' notice, the Photographer may treat the booking as cancelled and the €50 deposit may be retained.
A new deposit may be required to arrange a future booking.
4. Prices & Additional Costs
The price of your chosen photography package will be confirmed at the time of booking.
Each package includes only the services and number of photographs specifically stated in the package description or booking confirmation.
Additional photographs are available to purchase at an additional cost.
The price of additional photographs will be communicated to the Client before purchase.
Additional services, products, prints, albums, extended shooting time, travel or other items not included in the selected package may incur additional charges.
5. Payment
The €50 booking deposit is payable at the time of booking.
The remaining balance must be paid according to the payment arrangements communicated to the Client.
The Photographer reserves the right to withhold delivery of final photographs or products where an outstanding balance remains unpaid, subject to applicable law.
6. Photography Style
By booking Ana Boicenco Photography, you acknowledge that you have viewed my portfolio and are booking me based on my photographic and editing style.
I will use my professional judgement regarding lighting, composition, posing, image selection, colour and editing.
I cannot guarantee any particular pose, expression, photograph, background, lighting condition or specific image requested by the Client.
Every photography session is unique, and the final gallery will reflect my professional and artistic style.
7. Image Selection
Where your package includes a specific number of photographs, only the number stated in your package is included.
If you would like additional photographs beyond your package allowance, these may be purchased separately at the applicable additional-photo rate.
The Photographer will provide information regarding additional photographs and pricing when applicable.
8. Editing & Retouching
All photographs delivered to the Client will be edited according to the Photographer’s established artistic style.
Standard editing may include adjustments to:
Exposure
Colour
Contrast
Cropping
Skin tones
Lighting
Overall appearance
Requests for extensive retouching or significant alterations may incur an additional charge and are subject to the Photographer’s agreement.
The Photographer’s artistic editing decisions are final.
9. RAW & Unedited Images
RAW files and unedited photographs are not provided to Clients.
The Client will receive only the final edited photographs included in their selected package or subsequently purchased.
RAW files, rejected images, test photographs, outtakes and other unedited material remain the property of the Photographer.
10. Gallery Delivery
Your final edited photographs will be delivered through an online gallery.
The expected delivery time for the final gallery is within one week of the photography session, unless otherwise communicated.
The Client is responsible for downloading and safely storing their photographs once the gallery has been delivered.
Online galleries may only be available for a limited period. The Photographer is not responsible for permanently storing Client photographs.
If a gallery needs to be restored after it has expired, an additional administration or re-upload fee may apply.
11. Copyright
All photographs created by Ana Boicenco Photography remain the intellectual property and copyright of the Photographer unless otherwise agreed in writing.
Purchasing a photography package or digital photographs does not transfer copyright ownership to the Client.
The Client receives a personal, non-exclusive licence to use the delivered photographs for personal, non-commercial purposes.
The Client may share their photographs on personal social media.
Photographs must not be commercially sold, licensed, materially altered, submitted for commercial advertising or otherwise commercially exploited without written permission from the Photographer.
Commercial usage may require a separate licence and additional fee.
12. Social Media & Portfolio Consent
The Photographer may wish to use selected photographs from a Client’s session on:
Website
Portfolio
Advertising
Promotional materials
Photography competitions or exhibitions
A separate Photography & Social Media Consent Form will be provided to the Client and must be completed when paying the €50 booking deposit.
The Client may choose whether or not to provide consent in accordance with the options presented in the consent form.
A Client’s decision regarding promotional use will not affect the quality or terms of the photography service.
Where photographs include children, appropriate consent will be obtained from the relevant parent or legal guardian.
13. Privacy & Personal Data
Ana Boicenco Photography may collect personal information necessary to arrange and provide photography services.
This may include:
Name
Email address
Telephone number
Booking information
Session details
Payment information
Information voluntarily provided by the Client
Personal information will be handled in accordance with applicable Irish data protection legislation, including the GDPR.
Personal information will not be sold to third parties.
Information may be shared with trusted service providers where necessary to provide the photography service, such as online gallery providers, professional print laboratories or payment providers.
Further information may be provided in the Photographer’s Privacy Policy.
14. Client Responsibilities
The Client is responsible for providing accurate booking information and arriving at the agreed location at the agreed time.
The Client is responsible for the behaviour and supervision of children and other people attending the session with them.
The Photographer reserves the right to stop or modify a session if circumstances become unsafe or inappropriate.
15. Newborn & Children’s Photography
For newborn and children’s sessions, safety and wellbeing always take priority over obtaining a particular photograph.
The Photographer may refuse or modify any pose, setup or request that they reasonably consider unsafe.
Parents or legal guardians remain responsible for the supervision and safety of their children throughout the session.
The Photographer may pause, modify or end a session if a child is distressed, unwell or if continuing would create an unsafe situation.
16. Late Arrival
Clients are expected to arrive on time.
If the Client arrives late, the session may need to be shortened to ensure that subsequent bookings are not affected.
The Photographer will make reasonable efforts to accommodate late arrivals where possible, but the original finishing time may remain unchanged.
17. Outdoor Sessions & Weather
For outdoor sessions, weather and environmental conditions may affect the photography session.
If weather conditions make the session unsafe or unsuitable, the Photographer may recommend rescheduling the session or moving to an alternative location.
The Photographer cannot guarantee specific weather, lighting or environmental conditions.
18. Photographer Cancellation
In exceptional circumstances, including illness, injury, emergency, severe weather, equipment failure or circumstances beyond reasonable control, the Photographer may need to cancel or reschedule a session.
Where possible, the Photographer will offer the Client an alternative date.
If the Photographer cancels and is unable to offer a suitable alternative date, the €50 booking deposit will be fully refunded to the Client.
Any other amounts paid for services that cannot be provided will be dealt with in accordance with applicable Irish consumer law.
19. Technical Failure
The Photographer uses professional equipment and reasonable precautions to protect Client photographs.
In the unlikely event of equipment failure, memory-card failure, data corruption or another technical problem, the Photographer will make reasonable efforts to recover or recreate the affected work where possible.
Nothing in these Terms & Conditions limits any statutory rights or remedies available to the Client under Irish law.
20. Printed Products
Where prints, albums, canvases or other physical products are purchased, these will be charged separately unless specifically included in the selected package.
Colours displayed on computer, phone or tablet screens may differ from printed colours.
The Photographer cannot guarantee an exact match between a Client’s screen and a physical print.
Third-party laboratory production and delivery times may vary.
21. Complaints
If you have any concerns regarding your photography service or photographs, please contact Ana Boicenco Photography as soon as reasonably possible.
The Photographer will make reasonable efforts to investigate and resolve genuine complaints fairly and promptly.
Your statutory rights under Irish consumer law are not affected by this complaints procedure.
22. Consumer Rights
These Terms & Conditions are intended to operate alongside, and not replace, the Client’s statutory rights under Irish and applicable EU consumer protection law.
Nothing in these Terms & Conditions excludes or restricts any right or remedy that cannot legally be excluded or restricted.
Where a booking is made online or otherwise qualifies as a distance contract, additional cancellation rights may apply in certain circumstances.
23. Governing Law
These Terms & Conditions are governed by the laws of the Republic of Ireland.
Any dispute arising from the provision of photography services will be dealt with in accordance with applicable Irish law and the Client’s statutory rights.
24. Acceptance of Terms
By paying the €50 booking deposit, the Client confirms that they have had the opportunity to read and understand these Terms & Conditions and agrees to them, subject to their statutory rights.
The Client will also be asked to complete the applicable Photography & Social Media Consent Form when paying the deposit.
